Terms and conditions

General conditions of sale General:

All sales of the company DiagDeSpy are subject to these general conditions of sale which prevail over all other stipulations, unless expressly waived in writing by DiagDeSpy.

Responsibility :

  • DiagDeSpy cannot be held responsible and no refund will be possible in the event of effective dismantling of elements and non-compatibility of parts supplied by the customer or hidden defects due to subsequent interventions. The installation of non-approved parts called (Performance), reprogramming, installation of Xenon or LED kits is governed by articles R321-16 / R.313-1 to R.313-35 of the Highway Code, this may to lose the manufacturer's warranty, to be used by insurers not to cover claims and is reserved for motor racing, closed lanes, rallies, meetings, circuits, etc. It is also the customer's responsibility to inform the Department in charge of the environment, planning and housing (DREAL) in the event of the vehicle being transformed in order to be able to use the public road.

  • Static or dynamic particle filter regeneration procedures involve risks (breakage of mechanical parts due to fire). DiagDeSpy cannot be held responsible for any damage during this service and also during tests and passages on the power bench.

Site shop: 

  • The sale of Chiptuning solutions sometimes require interventions using a diagnostic tool or mechanically. The customer is informed of the interventions to be planned according to the files and assumes them entirely. The right of withdrawal is not possible in accordance with Article L221-28 of the Consumer Code.

  • The electronic products on sale on our shop are tested before being put on sale, no return, exchange, refund will be possible for this type of product.

  • Please check the product description for compatibility for mechanical parts and accessories. In the event of an error, only reimbursement is possible according to our terms (see sectionreimbursement of purchases of items on the site  of the T&Cs below) 

Purchasing items on the site:

It is recommended to read the item descriptions carefully before making a payment, if in doubt use the contact form, the email function or our social networks for more information.

Refunds for purchases of items on the site:

Refunds for items will only be made as follows:

  1. ReferenceUNIQUELYmechanical parts or accessories bearing the mention (possible review in the event of an error in their item description ), 7 days after their date of receipt for items in shipment (Chronopost tracking).

  2. Returned items must be in perfect condition (otherwise will result in a refusal of reimbursement).

  3. Return costs will be borne by the customer in the event of shipment.

  4. The refund will be made after receipt of the item and verification, in the form of a bank transfer with deduction of the costs incurred by our payment partners and after receipt of your payment.

  5. Paypal transaction 2.9% + 35 cents of the total amount.

  6. CB transaction via SumUp 2.5% of the total amount.

Service reservations on the site:  

  1. It is recommended to contact us via the contact form, by email or via our social networks in order to check whether the requested service is feasible or not.

  2. Once this verification has been carried out, availability must be taken into account as well as the duration of the intervention before booking a service.

  3. Remember to add any additional services necessary to your basket before making your reservation and payment.

Cancellation / postponement service on the site:

 

For any cancellation please contact us 24 hours in advance. 

For postponements, the next closest reservation will be studied with you.

Refunds for service reservations:  

  • Refunds in the event of cancellations or incapacity on our part will only be made by bank transfer with deduction of the costs incurred by our payment partners and after receipt of your payment:

  • Paypal transaction 2.9% + 35 cents of the total amount.

  • CB transaction via SumUp 2.5% of the total amount.

Specific to keys:

  • The reproduction of the keys will depend on the coverage of our tools, the validation of the necessary information and documents.No means of audiovisual capture is tolerated during the intervention.We offer OEM or AFTERMARKET keys as needed and reserve the right to use or not the blank keys provided by the customer.

Guarantees:

  • Mechanical/maintenance/audiovisual: DiagDeSpy is committed to an obligation of result except in cases of force majeure or provisions contrary to the GCS.

  • Chiptuning Solutions (shop): Delivery by email, after payment and receipt of the request file, within 48 hours of receipt except in cases of force majeure.

  • Reprogramming: The DiagDeSpy software warranty only covers reprogramming performed on the vehicle. DiagDeSpy undertakes to reprogram at its expense the vehicle to be returned to its original configuration within 5 years from the effective date of reprogramming. Guarantee valid only if the vehicle is in perfect mechanical condition, has not undergone any modification, whatever its nature, since the intervention of DiagDeSpy and does not present any fault code on diagnosis.

 

Price :

  • The prices indicated by DiagDeSpy are net prices. VAT is not applicable because DiagDeSpy is franchised from VAT. Due to continuous updating, the products and their prices may be changed at any time. The final price to be taken into consideration and invoiced will be that indicated on the estimate signed by the customer during the purchase or that of the basket for the purchase via our site. Possible customs fees and other import-export duties will be invoiced in addition to the customer.

Off-site payment:

  • The accepted currency is the Euro (€), the payment methods accepted by Diagdespy are as follows: Bank card / cash / payment links or QR CODE / Bank transfer to the following coordinates: IBAN: FR76 3000 4031 4400 0106 6860 356

Payment on the website:

  • Bank card / Paypal (4X possible depending on eligibility, indicated at the time of purchase)

Fixed compensation for recovery costs and late payment penalties:

  • Lump-sum compensation of €40 for any professional pursuant to decree no. 2012-1115 dated October 2, 2012, in addition to late payment penalties, i.e. 3 times the legal interest rate in force (article L. 441-6, I , paragraph 12 of the Commercial Code)

 

Termination clause by right:

  • In the absence of payment by the purchaser of the sums due to DiagDeSpy, the sale may be resolved automatically by simply sending a registered letter with acknowledgment of receipt referring to this clause, without prejudice to the damages to which DiagDeSpy could to claim.

Protection of personal data :

  • The information concerning you is kept in accordance with the provisions of law n ° 78-17 of January 6, 1978, relating to data processing, files and freedoms. You have, upon prior written request, a right of access, modification, rectification and deletion from DiagDeSpy, for all the information communicated. Disability:

  • If one or more stipulations of these T&Cs should be held to be invalid or declared as such pursuant to a law, regulation or court decision that has become final, the other stipulations of the T&Cs would retain their force. and their scope, and the invalid clause would be replaced by a valid provision whose content will conform to the original intention of DiagDeSpy.

Applicable law and attribution of jurisdiction:

  • The applicable law is French law. In the event of a dispute, the French courts will have sole jurisdiction and only French law will be applicable.

Conclusion of contract:

  • The contract is concluded by the simple signature of the estimate by the customer or by the validation of the GCS for purchases on our site. This translates into full knowledge and acceptance of these T&Cs.
